February 28, 2019: Making full use of his Scientology PR training, GPB Capital Holdings CEO David Gentile euphemistically spun the FBI’s execution of a search warrant at the firm’s NYC as “an unscheduled visit.”
GPB Capital’s Five Star Waste Management facility in New York City also experienced an unscheduled visit by the FBI on the same day.
The FBI got everything including GPB Capital’s servers, laptops, and paper documents.
Wanting to get ahead of the story, CEO David Gentile quickly informed investors of the FBI’s rude, inconvenient, and inconsiderate unscheduled visit on that fateful Thursday afternoon in February 28, 2019:

The FBI’s rude, inconvenient, and unscheduled visit turned into US Federal criminal charges against Gentile and his co-defendants Jeffry Schneider and Jeff Lash:
Fast forward to February 2024:
- Jeff Lash agreed to a plea deal in May 2023 to serve 120 months in Federal prison for his role in the GPB Capital Ponzi-like scheme. As a condition of his plea deal, Lash allocuted in Federal Court and directly implicated David Gentile in one count of wire fraud. This crime carries a maximum prison sentence of 240 months. Lash is expected to testify against Gentile in the latter’s upcoming criminal trial in June 2024.
x - David Gentile’s co-defendant Jeffrey Schneider filed six pretrial motions to suppress the fruits of the Google search warrant obtained by the FBI. The warrant allowed the FBI to search Schneider’s Google account jeffryschneider@gmail.com. Judge Gujarati denied all six motions.
x - Not to be deterred — and also because GPB Capital’s investors are legally required to pay all of his legal bills — Jeffry Schneider filed a renewed motion to suppress the fruits the Google search warrant on February 20, 2024. Scroll down to read Schneider’s motion and the Government’s opposition to the motion.
x - Our analysis is as follows:
x
A) David Gentile will not be able to overcome the documented evidence of wire fraud and the testimony against him by Jeff Lash. We predict Gentile will be convicted on this charge.
x
B) The evidence shows that Jeffry Schneider told his business associates to contact him via his personal Gmail account in order to avoid FINRA broker scrutiny of his business email account. The evidence found in his personal Gmail account appears to be more than sufficient to result in his conviction. It is for this reason that Schneider is now making a renewed motion to keep the evidence found in his personal Gmail out of his criminal trial. We predict this renewed motion will once again be denied by Judge Gujarati as was the original motion on February 13, 2024.
x
C) Jeffry Schneider’s frantic legal efforts to keep the evidence from his personal Gmail account out of his criminal trial suggests to us that this account is where all the dirt was buried.
x
D) We wonder why Jeffry Schneider used a Gmail account given his self-proclaimed genius: Did no one tell him about encrypted email or how it works? Schneider was the number two guy in an extremely complex $1.7 billion private equity fraud and yet he failed to spend $49.95 for an encrypted e-mail account. He was clearly not the smartest man in the room at Ascendent Capital.
