GPB Capital Update: Newly Convicted Felons David Gentile and Jeffry Schneider File Motions to Get Charges Dismissed; an Acquittal; and a New Trial

Following an eight week long trial, the jury took four hours to convict David Gentile and Jeffry Schneider on all counts. The crimes the two committed carry a maximum sentence of 240 months in US Federal Prison.

David Gentile filed three post-conviction motions on September 13, 2024. Scheider joined in these motions by a letter to the court: 

1. Motion to Dismiss the Indictment Based On Prosecutorial Misconduct: 

PLEASE TAKE NOTICE that upon the accompanying Memorandum of Law, Defendant David Gentile will move this Court, before the Honorable Rachel Kovner, United States District Judge for the Eastern District of New York, at the United States Courthouse located at 225 Cadman Plaza E, Brooklyn, New York, 11201, on a date and time to be determined by the Court, for an Order granting Defendant David Gentile’s Motion to Dismiss the Indictment Based On Prosecutorial Misconduct.

2. Motion for a Judgment of Acquittal: 

PLEASE TAKE NOTICE that upon the accompanying Memorandum of Law, Defendant David Gentile will move this Court, before the Honorable Rachel Kovner, United States District Judge for the Eastern District of New York, at the United States Courthouse located at 225 Cadman Plaza E, Brooklyn, New York, 11201, on a date and time to be determined by the Court, for an Order granting Defendant David Gentile’s Motion for a Judgment of Acquittal.

3. Motion for a New Trial: 

PLEASE TAKE NOTICE that upon the accompanying Memorandum of Law, Defendant David Gentile will move this Court, before the Honorable Rachel Kovner, United States District Judge for the Eastern District of New York, at the United States Courthouse located at 225 Cadman Plaza E, Brooklyn, New York, 11201, on a date and time to be determined by the Court, for an Order granting Defendant David Gentile’s Motion for a New Trial. During the pendency of their criminal trial, Gentile and Schneider’s separate defense teams submitted numerous motions and sent letters to the judge. This criminal case has went on for years and now the newly-convicted felons Gentile and Schneider want the charges dismissed, an acquittal, and a new trial. 

This seems illogical because if the GPB Capital criminal duo were acquitted and the charges  dismissed, then there would be no need for a new trial. 

This is desperation, a post-conviction attempt due to escape the 20 year prison sentence which is a consequence of their own actions.


We have all the documents and will be posting them. Below we post Gentile’s 152-page motion for a new trial. 

To read Gentile’s motion makes it seem like he and Schneider were railroaded by a dirty judge in league with corrupt prosecutors. Comically, and quite ironically, Gentile’s motion actually reads like a jailhouse pro se complaint alleging ineffective assistance of counsel during the seven week trial; the motion reads as if Gentile and Schneider’s high-priced criminal defense lawyers were slack-jawed and clueless yellow page lawyers who were too inept to see or defend against the vast machinations alleged by the two newly-minted felons. 

As we documented, Gentile and Schneider spent $108 million in legal defense fees over the past several years and were still convicted on all charges. To make it all the worse, Scientology has forgotten David Gentile’s name. He’s now just a guy who read a book and did a few courses way back when.

  1. Is the motion to dismiss, motion for acquittal and motion for a new trial all going to be presented to Rachel Kovner, United States District Judge or will it be a new judge? How quickly could all of this happen? Is the Receivership ever going to get initiated?

  2. Are all the motions to be given to Rachel Kovner, United States District Judge or a different Judge? How long could this take? Is there any update on the Receivership status?

  3. The second circuit has a hearing scheduled for the Receivership for the week of Nov 4th- that is the SEC case. That case is separate from the criminal case with judge Kovner who will rule on the various motions in the criminal matter after oct 14 and 29 responses. The receivership could go forward if the 2nd circuit allows it after Nov 4th week hearings regardless of the criminal motions. The criminal sentencing is March 6.

  4. Has Schneider and Gentile been sentenced yet? Originally they were scheduled for late October but I haven’t seen any updates in a while. Thanks in advance for any insight.

  5. Sentencing is in the March-April 2025 timeframe. This is subject to change as the convicted felons are filing motions to extend; the goal being to avoid prison for as long as possible in the futile hope the are acquitted of all charges and/or get a new trial.
