OT’s in Action: Four Scientologists Arrested & Indicted in $80 Million Medicare Fraud

Scientology OT’s Jeffrey and Jim Spina have been charged with felonies along with two other Scientologists

According to a US Dept of Justice Press Release of August 30, 2018 Scientologists James Spina, Jeffrey Spina, Andrea Grossman, and Kimberly Spina have been charged with “participating in a widespread health care fraud scheme through their fraudulent operation of Dolson Avenue Medical (“DAM” or the “Practice”), a multi-disciplinary medical clinic located in Middletown, New York.” The Spina brothers are chiropractors and used their practice to engage in the alleged fraud with their accomplices.

The US DoJ press release adds, “The defendants were all arrested today, and presented in federal district court in White Plains. This case has been assigned to U.S. District Court Judge Kenneth M. Karas.” These Scientologists were arrested, booked, and processed. The Times-Herald Record Online reported on bail conditions for the defendants:

The Spina brothers hid behind a facade of being upstanding philanthropists involved in their communities. They also participated in Scientology’s phony front group Drug Free World.

As the US DoJ press released noted, a co-conspirator in this case named Dr. Charles Bagley has pleaded guilty to conspiracy to commit health care fraud.

    What’s clear is that there is a nexus of fraud around WISE healthcare-related enterprises and Narconon. This nexus is based on what would appear to be a template that details organizational, personnel, and financial structures designed to enable fraudulent Medicare billing in a way that is scalable, relatively sophisticated, and most importantly, easily repeatable.

    What should worry Scn is the discovery in the various Narconon trials, the Hanan Islam trial, and now the Spina brothers indictment, will undoubtedly be able to demonstrate at a minimum, conspiracy to defraud, given the behavioral similarities among the various defendants, the deliberate targeting of public money for personal gain, and the endemic influence of Scn throughout all the criminal enterprises involved.

    Significantly, it reflects a pernicious and ongoing pattern of criminality across a variety of Scn front groups. As a result, such behavior appears to be nothing more than racketeering, and a great start to a RICO indictment.

    I note that the Spinas have spent time on the Freewinds; I wouldn’t be surprised if part of their time aboard was spent delivering detailed seminar instruction on Medicare fraud under the guise of “Prosperity Seminars”, in keeping with LRH’s mandate of “make money, make more money” to illicitly fund one’s “Bridge”. Ironic, in that one fraud begets another…

  2. Thank you for your insights Dr. Wasel. It is interesting you would mention a nexus of fraud. Indeed, allegations of insurance fraud involving Scientology occurred in 2013. Specifically, the Narconon facility in Norcross, Georgia was raided on April 26, 2013 by the authorities in an insurance fraud investigation.     The outcome of the Narconon Georgia fraud investigation as reported by the Atlanta Journal-Constitution:

    “A controversial Norcross drug treatment facility with ties to the Church of Scientology will avoid any potential criminal charges after surrendering its license to the state… the state insurance commissioner and Porter launched an investigation into allegations by the mother of a former patient who said her insurer was billed $166,275 for doctor visits that never occurred and treatment that was never provided. State investigators said they had uncovered nearly $3 million in alleged insurance fraud by Narconon of Georgia.”
